What we collect, and what we do with it.
Plain version: we collect what we need to set up your restaurant and talk to you about it. We don't sell it, and we don't share your guests' details with anyone who might compete with you.
Who we are
Orme provides commission-free online ordering software to restaurants in Canada and the United States. We operate from 1019 Kingston Road, Toronto, Ontario, and we are the party responsible for the information described here.
What we collect from restaurant owners
When you request a walkthrough or open an account we collect your name, email, mobile number, restaurant name and location, how many sites you run, and how you heard about us. If you become a customer we also hold billing details, menu content, opening hours and the settings you configure.
What we collect from your guests
When someone orders through your Orme page we collect the details needed to complete that order: name, contact details, delivery address where relevant, order contents and payment confirmation. We process this on your behalf. It is your customer list, not ours.
What we never do
We do not sell your data or your guests' data. We do not use your guest list to market to them on our own behalf, and we never share it with other restaurants or with third-party delivery platforms.
Why we hold it
To set up and run your ordering system, take payments, provide support, send you service messages, and, where you have agreed, send you occasional messages about Orme. Consent to marketing messages is never a condition of using the product.
Who we share it with
Only the services needed to run the product: payment processing, hosting, email and SMS delivery, and delivery dispatch when you use it. Each receives the minimum required and is bound to use it only for that purpose.
Text messages
If you tick the SMS box when booking a walkthrough, you agree to automated text messages to help schedule it, roughly four a month. Consent is not required to book. Message and data rates may apply. Reply STOP to unsubscribe or HELP for help. We follow Canada's anti-spam law (CASL) and, in the United States, the TCPA and CAN-SPAM.
How long we keep it
For as long as you have an account, and afterwards only as long as needed to meet legal, tax and accounting obligations. You can ask us to delete anything we are not required to keep.
Your rights
Wherever you are, you can ask to see the information we hold about you, correct it, export it, or have it deleted. Email privacy@orme.io and we will respond within thirty days.
Canadian and US privacy law
For Canadian restaurants and guests we handle information in line with PIPEDA and, where it applies, provincial privacy legislation such as Quebec's Law 25. For US restaurants and guests we honour the rights given by state privacy laws including the CCPA and CPRA in California, including the right to know, delete, correct and opt out of any sale or sharing of personal information. We do not sell personal information in any jurisdiction.
Where your information is stored
Our systems are hosted in Canada and the United States, so information may be processed in either country and may be subject to lawful access requests there. We use providers contractually bound to protect it to the standard described on this page.
Cookies
We use cookies to keep you signed in, remember basket contents and understand which pages help restaurants find us. Some of these come from analytics and advertising services, including Google Analytics and the Meta pixel, which lets us measure whether our own ads and articles bring restaurants to the site and show Orme ads to people who have visited it. You can block them in your browser, though parts of the ordering flow may stop working.
Changes
If we change how we handle information in a way that affects you, we will tell you by email before it takes effect.
The deal between us.
Plain version: you pay a flat fee, we run your direct ordering, nobody takes a commission, and either of us can walk away.
What you are agreeing to
By opening an Orme account you agree to these terms. If you are agreeing on behalf of a business, you confirm you are entitled to do so.
What we provide
Software for taking direct orders: your ordering page, website, customer records, loyalty, catering, marketing tools and integrations with your point of sale and printers, according to the plan you are on.
What it costs
A flat subscription fee, billed weekly or annually as you choose. Orme takes no commission on any order, at any volume. Canadian restaurants are billed in Canadian dollars and US restaurants in US dollars. Sales tax, GST or HST is added where applicable. Prices can change with thirty days' notice, and any change takes effect at your next renewal.
Cancelling
On weekly billing you can cancel at any time and it takes effect at the end of the current week. There is no notice period and no exit fee. On annual billing, tell us within sixty days of purchase and we will refund the year in full.
Our savings guarantee
If Orme has not saved you more in avoided third-party commission than you paid us during your first sixty days, we will refund the difference. We will ask to see the relevant statements to work it out.
Your responsibilities
Keeping your menu, prices, hours and allergen information accurate; fulfilling the orders you accept; holding the licences and insurance your business requires; and following the food-service, tax and consumer law that applies in your province or state, including menu labelling and accessibility rules where they apply to you.
Your content and your data
Your menu, images, brand and customer records stay yours. You give us permission to host and display them so the product can work. If you leave, you can export your customer list and order history.
Payments to you
Guest payments are processed by our payment partner and settled to your account. You are responsible for the tax treatment of your own sales.
Guest fees
Guests ordering through your Orme page may be charged a service fee, and a delivery fee where delivery applies. We will always tell you what those are before you go live.
Availability
We work to keep the service running at all times but cannot guarantee it will never be interrupted. Where an outage is our fault and material, tell us and we will credit the affected period.
Limits
The service is provided as it is. To the extent the law allows, our total liability in any twelve-month period is limited to what you paid us in that period. We are not liable for lost profits or indirect losses.
Ending the agreement
You can leave at any time as described above. We can end an account for non-payment, or for use that is illegal or that puts other users at risk, with notice wherever it is possible to give it.
Governing law
These terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there, and any dispute goes to the courts of Ontario. If you are a US restaurant, nothing here removes any right you have under the law of your own state that cannot be waived by agreement.
